For example this one out of Utah shows us what can happen when there is insufficient evidence when considering a conviction. The point is, don’t give the D.A. information they can use to get a conviction.

U.S. Ski and Snowboard Association President William C. Marolt, originally charged with driving under the influence, has been ticketed for a lesser offense.

Summit County Justice Judge Shauna L. Kerr last week approved an improper usage of lanes ticket, a Class C misdemeanor, and a $90 fine for Marolt. Walter F. Bugden, Marolt’s attorney, said prosecutors reviewed the case and found no evidence supporting the DUI charge.

“I agree that my client made a traffic violation,” Bugden said. “I’m just grateful that [Park City Attorney] Tom Daley took the time to review all the evidence and conclude he had a definite insufficient basis to [stick with the DUI charge].”

Bugden also said he believed the arresting officer would not have arrested Marolt had he spent more time with him.

Daley was unavailable for immediate comment.

Marolt, 66, was initially charged with driving under the influence and failing to yield to an emergency vehicle on March 17.

Marolt was a 1964 Olympian, and served as U.S. Alpine skiing director of the U.S. Ski Team, according to the association’s website. He was also athletic director at the University of Colorado. Marolt became president of the USSA in 1996, and resides in Park City.
